Thank you for the opportunity to testify today on the Department of Homeland Security’s (DHS) role in protecting against the continued assaults by criminals and violent extremists in the city of Portland, Oregon and more specifically, the Federal Courthouse and federal law enforcement officers there.
The U.S. Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP), U.S. Border Patrol (USBP) conducts searches of electronic devices to identify violations of the laws CBP enforces and administers, including laws relating to the detection and apprehension of illicit goods and individuals entering and exiting the United States in between ports of entry (POE). Depending on the circumstances, CBP conducts searches of electronic devices pursuant to different legal authorities. CBP is publishing this Privacy Impact Assessment (PIA) update to analyze the privacy risks of expanded digital forensic tools and an enterprise-wide solution for managing and analyzing certain types of metadata that USBP collects from electronic devices across its digital forensic collection activities. In addition, this updated PIA will clarify that searches may be conducted pursuant to border search authority.

The U.S. Department of Homeland Security (DHS) U.S. Customs and Border Protection (CBP) uses a combination of surveillance systems, including license plate reader technology, to provide comprehensive situational awareness along the United States border to assist CBP in detecting, identifying, apprehending, and removing individuals illegally entering the United States at and between ports of entry or otherwise violating U.S. law. In 2017, CBP published a Privacy Impact Assessment (PIA) describing its use of commercially available fixed and mobile license plate reader technology. CBP is conducting this Privacy Impact Assessment (PIA) update to provide public notice of CBP’s use of license plate reader data procured from commercial vendors.

In response to New York State implementing the Driver’s License Access and Privacy Act (Green Light Law), Acting Secretary Chad F. Wolf announced New York residents will no longer be eligible to apply for or renew their enrollment in certain Trusted Traveler Programs (TTP) like Global Entry. The law prohibits the Department of Motor Vehicles (DMV) from sharing information with U.S. Department of Homeland Security (DHS), preventing DHS from fully vetting New York residents.
